Terms of Service

1. Eligibility and accounts

You must be at least 18 years old, able to enter into a binding agreement, and located in the Philippines. Keep your account information accurate and your login credentials secure. You are responsible for activity performed through your account.

2. Free items only

Items listed on FreeNearby must be offered without a purchase price, mandatory fee, deposit, trade, or hidden condition. Do not use the service to advertise sales, paid services, rentals, or commercial promotions.

3. Listings and prohibited items

Describe items honestly and use photos you are entitled to share. You may not list illegal, stolen, unsafe, recalled, counterfeit, regulated, or hazardous items. Prohibited items include weapons, drugs, alcohol, tobacco and vaping products, prescription medicine, live animals, personal data, financial products, and anything that violates another person's rights.

4. Pickup arrangements

Users are responsible for deciding whether, when, and where to meet. Use public places where practical, tell someone you trust about the pickup, inspect an item before accepting it, and cancel if something feels unsafe. A request or confirmed time does not transfer ownership or guarantee completion.

5. Messages and Credits

Sending a message uses the number of Credits shown in the app. Weekly or promotional Credits have no cash value and may expire or reset. Purchased Credits are recorded to your account and may be subject to payment-provider rules, fraud review, and applicable refund rights. Credits cannot be sold, transferred, or redeemed for cash.

6. Respectful use

Do not harass, threaten, discriminate against, deceive, spam, impersonate, track, or exploit another person. Do not scrape the service, bypass access controls, manipulate Credits, interfere with security, or use FreeNearby for unlawful activity.

7. Moderation

We may review, limit, reject, remove, or preserve content and may warn, suspend, or close accounts where reasonably necessary to enforce these Terms, address reports, protect users, comply with law, or maintain the service. We may act without advance notice in urgent or serious cases.

8. Third-party services

FreeNearby relies on third-party services for maps, authentication, messaging, hosting, and payments. Their terms may also apply. We are not responsible for third-party services outside our reasonable control.

9. Disclaimers and responsibility

Items are provided by users, not by FreeNearby. We do not own, inspect, guarantee, or endorse listed items or users. To the extent permitted by law, the service is provided on an “as available” basis, and each user assumes responsibility for listings, communications, meetings, and items they give or receive. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

10. Changes, governing law, and contact

We may update the service and these Terms. Material changes will be communicated through the service or by another reasonable method. These Terms are governed by the laws of the Republic of the Philippines, without limiting mandatory consumer or privacy protections.
